Taiwan Announced Full Implementation of GHS by 2016 - Additional Fine May Be Levied Per Violation of Noncompliance

By January 1, 2016, full implementation of United Nations’ Globally Harmonized System on the classification and labelling of chemicals (GHS) in workplace is to be adopted in Taiwan, according to Ministry of Labor, MOL. This effort strengthens labors’ right to know, assures sound management on safe use of chemicals, and brings Taiwan’s workplace safety in line with international standards.

In accordance with UN GHS, MOL issued the Regulation of Labelling and Hazard Communication of Dangerous and Harmful Materials on October 19, 2007. To allow more flexibility and applicability, a three-stage phase-in announcement is made with hazardous substances lists, which covers 3,171 substances in total. On December 23, 2013, MOL announced the schedule of full GHS implementation commencing the beginning of 2016, with a view to having international standards alignment.

Fu Huan-jan (傅還然), head of the Occupational Safety and Health Administration, OSHA, said, “Occupational Safety and Health Act” has been amended and promulgated by the Presidential Order on July 3, 2013. According to the Article 10, the manufactures, importers or suppliers of the chemicals shall provide labels and safety data sheets. Violation is subject to a fine of no less than NT$30,000 but no more than NT$150,000. If notification has been given to make improvements within a limited time period but failed to do so, an additional fine per violation may be levied.
